That is correct, any use of frequencies outside the allowed and defined spectrum is a violation and should be subject to prosecution. Any thoughtless use would force an explanation for which communication that frequently is really used. That of course violates the need for privacy or secrecy. Arrogance and disrespect are false drivers in any such case.
