Dann zählt der Käufer gemäß der im Vertrag festgelegten Zahlungsfrist. Der Verkäufer freut sich und bestätigt gegenüber dem Notar den erfolgten Geldeingang.
Nun will der Käufer natürlich den Grundbuchauszug haben um gegenüber der Hausverwaltung als neuer Besitzer aufzutreten, denn er muß ja an die Hausverwaltungsgesellschaft Hausgeld bezahlen.
Den Grundbuchauszug bekommt der Käufer aber nicht, weil die Hausverwaltung zum Zeitpunkt des Vertragsabschlußes ein Verwalternachweis und ein Verwalterprotoll zu senden muß und dies so nicht erfolgt ist oder nicht richtig verarbeitet wurde.
Nun hat zufälliger Weise auch die Hausverwaltung zum 1.1.2025 gewechselt. Den Nachweis zum Zeitpunkt des Vertragsabschlußes zu verlangen erscheint unsinnig, ist jedoch praktisch.
Und überhaupt hätte der Käufer gar nicht zahlen dürfen, denn der Notar muß hierzu eine Aufforderung schicken, daß der Papierkram in Ordnung ist. Das heißt der Staat hängt sich in Zahlungsfristen der Privatwirtschaft. Warum, weil die Geldströme wegen potentieller Geldwäsche kontrolliert werden müssen. Das ist illegal und muß illegal bleiben, denn der Staat verursacht durch die Nichtbewilligung der Zahlung eine Erhöhung der Zinslast des Käufers!
So ein verkompliziertes Verfahren kann nicht funktionieren.
